This book is a collection of secondary essays on America's most important philosophic thinkers—statesmen, judges, writers, educators, and activists—from the colonial period to the present. Each essay is a comprehensive introduction to the thought of a noted American on the fundamental meaning of the American regime.

This article summarizes the multitude of empirical studies that test ethical decision making in business and suggests additional research necessary to further theory in this area. The studies are categorized and related to current theoretical ethical decision making models. The studies are related to awareness, individual and organizational factors, intent, and the role of moral intensity in ethical decision making. In 1962 a mimeographed sheet of paper fell into my possession. It had been prepared by Ernest Adams of the Philosophy Department at Berkeley as a handout for a colloquim. Headed 'SOME FALLACIES OF FORMAL LOGIC' it simply listed eleven little pieces of reasoning, all in ordinary English, and all absurd. I still have the sheet, and quote a couple of the arguments here to give the idea. • If you throw switch S and switch T, the motor will start. (...) There fore, either if you throw switch S the motor will start, or, if you throw switch T the motor will start. • It is not the case that if John passes history he will graduate. Therefore, John will pass history. The disconcerting thing about these inferences is, of course, that under the customary truth-functional interpretation of and, or, not, and if-then, they are supposed to be valid. What, if anything, is wrong? At first I was not disturbed by the examples. Having at that time consider able personal commitment to rationality in general and formal logic in par ticular, I felt it my duty and found myself easily able (or so I thought) to explain away most of them. But on reflection I had to admit that my expla nations had an ad hoc character, varying suspiciously from example to example. (shrink)

Arguably, every new technology creates hidden ejfects in its environment, rearranging the social order it penetrates. Many ofthese effects are inextricably linked to ethical issues. Some are eternal issues such as censorship andfree speech, but others have new names and dimensions, and may even be new issues. Forty of these issues pertaining to the new communication technologies of the 1990s and next millennium are catalogued here. The author argues that each new communication technology either retrieves, amplifies, transforms, obsolesces, or mixes (...) ethical issues from the past or creates new issues for the future. However, as in the Ross Hume Hall (1974) effect, it is also likely there are issues yet unknown due to untested eflects of combining new technologies. (shrink)

Ender's tortured conscience is an illustration of the moral importance of following principles of just war theory—the “unspoken rules of manly warfare”—and their apparent tension with the demands of war and survival. This chapter talks about the ethics of conflict in Ender's various games—his battles and wars. It asks, was justice served in the Third Invasion and destruction of the bugger worlds, the event that came to be called the xenocide. Ender's life is actually a testimony to the just war (...) axiom that all people desire peace. In the tradition of just war theory, there are five principles that lay out the requirements of jus ad bellum, or how to go to war in an ethical way. However, in clinical practice, MMF dose reduction, interruption, or discontinuation due to hematological (...) and gastrointestinal side-effects occurred in up to 50% of the patients. Large retrospective analyses have demonstrated that patients requiring MMF dose manipulation due to adverse events experienced a higher rate of rejection and graft loss. Enteric-coated mycophenolate sodium was developed with the goal of improving upper GI side-effects. Here, we review the efficacy and safety of EC-MPS in de novo kidney transplant recipient, and in stable renal transplant patients who were converted from MMF. Biblical anthropology is demonstrably both holist and dualist. It is holist in teaching that God created, redeems, and will glorify humans as whole embodied persons. It is dualist in teaching that God created humans of two ingredients and that he sustains persons apart from their bodies between death and resurrection. This chapter shows that key arguments against dualism are compromised by problematic hermeneutics, conceptual confusions, and faulty reasoning. It also shows that monism cannot account for the texts which imply dualism, (...) and that dualism is compatible with holism. N. T. Wright corroborates the exegesis supporting these conclusions but defines and rejects dualism as incompatible with holism. Nevertheless, his understanding of holism is compatible with virtually all current Christian dualism. However, Joel Green's holistic exegesis, integral anthropology, and practical theology make valuable contributions that dualists can affirm. (shrink)

Confucianism and Legalism are two schools of Chinese philosophy. This chapter explores contrasts between Confucian and Legalist visions of the nation, the family, and the soul through Zuko's journey. It covers the tension between the legacies of his two great‐grandfathers, Sozin and Roku, and shows that the battle within Zuko and the royal family is at root a philosophical struggle between these two differing philosophical visions. Finally, the chapter addresses that Zuko's battle within reflects something true about human nature that (...) the Legalists and the Confucians partly grasped, and which one twentieth‐century villain‐turned‐hero, Aleksandr Solzhenitsyn, helps clarify. The Legalists emphasized natural tendencies toward evil. Zuko's story suggests that both schools point to something true in human nature, that human beings have the natural capacity for both good and evil, and that it is all too human to be deceived by evil masquerading as good. There has been a considerable amount of literature in the last 70 years claiming that the American founders were steeped in modern thought. This study runs counter to that tradition, arguing that the founders of America were deeply indebted to the classical Christian natural-law tradition for their fundamental theological, moral, and political outlook. Evidence for this thesis is found in case studies of such leading American founders as Thomas Jefferson and James Wilson, the pamphlet debates, the founders' invocation of providence (...) during the revolution, and their understanding of popular sovereignty. The authors go on to reflect on how the founders' political thought contained within it the resources that undermined, in principle, the institution of slavery, and explores the relevance of the founders' political theology for contemporary politics. This timely, important book makes a significant contribution to the scholarly debate over whether the American founding is compatible with traditional Christianity. (shrink)

We shall argue that there is adequate moral justification for capital punishment with linkage, that is, with linkage to keeping non-murderers from dying. We present the argument with two aims in mind. The first is to question the conventional wisdom, seldom challenged even by proponents of capital punishment, that being an abolitionist is closely connected to having a civilized respect for human life. This conventional wisdom, we hope to show, is somewhat off the mark. To this end we exhibit structural (...) similarities between so-called lifeboat dilemmas and the public's relationship to a murderer. In a lifeboat dilemma one must choose between saving this life or that, since the lifeboat will not hold both persons. Now if this life were an innocent's and that one a murderer's, a choice to save the latter would not be met with accusations of callousness towards human life. We hope to project everyone's intuitions about this case onto the more baffling case of a society's relationship to the murderers and dying innocents in its midst. (shrink)

The Planteome project provides a suite of reference and species-specific ontologies for plants and annotations to genes and phenotypes. Ontologies serve as common standards for semantic integration of a large and growing corpus of plant genomics, phenomics and genetics data. The reference ontologies include the Plant Ontology, Plant Trait Ontology, and the Plant Experimental Conditions Ontology developed by the Planteome project, along with the Gene Ontology, Chemical Entities of Biological Interest, Phenotype and Attribute Ontology, and others. The project also provides (...) access to species-specific Crop Ontologies developed by various plant breeding and research communities from around the world. I offer here a solution to a mystery about William James's theory of the self. Among the many students of James who have been mystified is Gerald Myers, who expresses surprise in William James: His Life and Thought that, given the religious and mystical overtones of his later metaphysics, James did not abandon the apparent bodily self of the earlier Principles of Psychology for a “nonbodily, spiritual, and mysterious referent for the first-person pronoun,” instead of consistently adhering “to his claims (...) that the body is at the center of any experience of self, that nothing nonbodily shows itself definitely to introspection, and that nothing about using I makes a mystery of the self”. The mystery is particularly deep because James explicitly avowed the coherence of the Principles treatment of the self with the later metaphysical treatment, such as the material in Essays in Radical Empiricism. Arguing in “Does ‘Consciousness’ Exist?” from the Essays that a metaphysics of pure experience should replace the dichotomy between consciousness and the body, James adduces in support his earlier discussion of the self: “In my Psychology I have tried to show that we need no knower other than the ‘passing thought’.” On the other hand, Myers observes, “if telepathy, clairvoyance, and precognition actually occur,” as James was disposed to think, “our everyday equation of the self with bodily experience will surely require some revision”. Then too James's religious convictions as expressed in The Varieties of Religious Experience would also seem to call for revision of the earlier equation. James wrote there, for instance, that “the visible world is part of a more spiritual universe from which it draws its chief significance” and that “union or harmonious relation with that higher universe is our true end.” “Yet instead of suggesting how his psychological concept of the self might have shifted during the progression from Principles to the metaphysics of pure experience,” Myers comments with a note of puzzlement, “James wrote in his later period that this concept was a natural ally if not the original herald of that metaphysics.”. In their responses to James Tully’s article “Deparochializing Political Theory and Beyond,” Garrick Cooper, Charles W. Mills, Sudipta Kaviraj and Sor-hoon Tan engage with different aspects of Tully’s “genuine dialogue.” While they seem to concur with Tully on the urgency of deparochializing political theory, their responses bring to light salient issues which would have to be thought through in taking this project forward.

This paper presents the findings of two surveys conducted in April 2003 of Chartered Life Underwriters (CLUs) and Chartered Financial Consultants (ChFCs) who are members of the Society of Financial Service Professionals. The first survey of 3000 CLUs and ChFCs – the life insurance industry’s most highly regarded professionals – was aimed at identifying the key ethical issues faced by professionals working in the life insurance industry today. A comparison of these findings with those of earlier studies conducted in (...) 1990 and 1995 suggests that while the key ethical issues facing those working in the life insurance business today are essentially the same as those encountered during industry’s highly troubled ethical environment of the early 1990s, these issues are perceived as presenting somewhat less serious problems than in the past. The second survey of 3000 CLUs and ChFCs was aimed at determining the extent to which these professionals perceive the industry created Insurance Marketplace Standards Association (IMSA) as having contributed to any change in the ethical environment that has taken place. The findings suggest that IMSA has played an important role in influencing senior managers to more strongly encourage and support ethical market conduct, a critical step in improving the industry’s ethical environment. A fundamental philosophical question that arises in connection with evolutionary theory is whether the fittest patterns of behavior are always the most rational. Are fitness and rationality fully compatible? When behavioral rationality is characterized formally as in classical decision theory, the question becomes mathematically meaningful and can be explored systematically by investigating whether the optimally fit behavior predicted by evolutionary process models is decision-theoretically coherent. Upon investigation, it appears that in nontrivial evolutionary models the expected behavior is not always in (...) accord with the norms of the standard theory of decision as ordinarily applied. Many classically irrational acts, e.g. betting on the occurrence of one event in the knowledge that the probabilities favor another, can under certain circumstances constitute adaptive behavior.One interesting interpretation of this clash is that the criterion of rationality offered by classical decision theory is simply incorrect (or at least incomplete) as it stands, and that evolutionary theory should be called upon to provide a more generally applicable theory of rationality. Such a program, should it prove feasible, would amount to the logical reduction of the theory of rational choice to evolutionary theory. (shrink)

Neutral monist, panpsychist, naturalist, and phenomenological interpretations of James's theory of mind are canvassed. Culling the true tenets from each, I make a case for a reconciling view on the basis of a distinction between mental and proto-mental properties. The resulting interpretation is compared to two forms of panpsychism identified by T Nagel in his essay of that name.

Here, we account multiple (...) stories from our respective experiences in an effort to improve healthcare institutions' awareness of the recommended modalities when communicating with Deaf patients accessing care. Our stories clarify any misunderstandings about communication with Deaf patients who expressively use spoken language and receptively use sign language. We convey that it is imperative to use visual language when explaining discharge paperwork and emphasize that it is critical for a Deaf caregiver to be fully aware of the plan of care when offering support to their loved one. We illustrate the importance of honoring the requests for in-person sign language interpreting versus video remote interpreting (VRI) as well as requests for Deaf-Hearing sign language interpreter teams. Deaf interpreters bring formative cultural, linguistic, and life experiences and work in partnership with a hearing interpreter to provide a more nuanced communication exchange across a wide range of visual languages.Maggie Russell: Anecdote 1The hospital recidivism rate for a Deaf Nepali male patient continues to increase. As the Interpreter Referral Service Director, I am aware of this patient because he receives care management services from our organization. He has several life-threatening conditions, attends dialysis, is on multiple medications, and is frequently in and out of the local hospital. The hospital considers him as someone who identifies as an oral Deaf person, as he has severe to profound hearing loss with little or no residual hearing and visually receives signed language but expressively uses spoken language. Three interpreters, a spoken Nepalese interpreter, a Deaf Nepali Sign Language (NSL) interpreter, and a hearing American Sign Language (ASL) interpreter, working together as a team are recommended for effective communication with this patient and the medical team of providers. However, interpreting services at the hospital provide only one interpreter, a spoken Nepalese interpreter, which [End Page E3] does not satisfy the necessary accommodations for access. A plethora of prescriptions were added to his regimen to counter the condition that caused a recent inpatient stay. The patient's wife is his primary caregiver. She communicates receptively and expressively using NSL. A Deaf NSL and hearing ASL interpreter team creates effective communication with his wife and the medical team of providers. Since she is expected to follow the doctor's recommendations as explained in the discharge instructions, she also requires accommodations for communication access. Neither the patient nor his wife received a formal education, and they do not read or write English or the language of their country of origin. Therefore, information in English or Nepalese conveyed in the printed discharge paperwork is inaccessible. The new medications were not incorporated into his already established monthly "pill pack," and the couple was unable to read the information on the pill bottles that were delivered to their home. Subsequently, incorrect use of the newly prescribed medications significantly delayed the patient's course of recovery. This couple also had minimal exposure to medical information and medical processes prior to living in the United States; the medical services in the refugee camps in Nepal were typically non-existent. Utilizing a hearing ASL interpreter alone does not constitute barrier-free access for either of these individuals. Interpreting medical documents in a visual format is so critical for providing access, but it doesn't necessarily guarantee comprehension because of their limited health literacy. The Plant Ontology (PO; http://www.plantontology.org/) is a publicly-available, collaborative effort to develop and maintain a controlled, structured vocabulary (“ontology”) of terms to describe plant anatomy, morphology and the stages of plant development. The goals of the PO are to link (annotate) gene expression and phenotype data to plant structures and stages of plant development, using the data model adopted by the Gene Ontology. From its original design covering only rice, maize and Arabidopsis, the scope of the PO has been expanded (...) to include all green plants. The PO was the first multi-species anatomy ontology developed for the annotation of genes and phenotypes. Also, to our knowledge, it was one of the first biological ontologies that provides translations (via synonyms) in non-English languages such as Japanese and Spanish. There are about 2.2 million annotations linking PO terms to over 110,000 unique data objects representing genes or gene models, proteins, RNAs, germplasm and Quantitative Traits Loci (QTLs) from 22 plant species. In this paper, we focus on the plant anatomical entity branch of the PO, describing the organizing principles, resources available to users, and examples of how the PO is integrated into other plant genomics databases and web portals. We also provide two examples of comparative analyses, demonstrating how the ontology structure and PO-annotated data can be used to discover the patterns of expression of the LEAFY (LFY) and terpene synthase (TPS) gene homologs. This paper examines several key aspects of the ethical environment facing the insurance industries of Poland, The Czech Republic and Hungary as they complete the transition from Communist insurance systems built upon state-owned monopolies to viable private domestic insurance markets, and then seek to harmonize their markets with the single insurance market of the European Union. Since many types of ethical problems encountered during the transition are unlikely to diminish significantly as a result of either privatization or regulation of the (...) insurance markets of these countries, measures are identified that should help to improve the ethical environments of these markets. In the essay “Justice and Rights” of his book Taking Rights Seriously Ronald Dworkin puts forward an account of reflective equilibrium which has become an orthodoxy in interpreting John Rawls' theory of justice. My purpose here is to challenge this account, on the grounds that it presupposes an untenable view of the relation between belief and choice.

The paper reports the findings of a study of CPAs designed to determine whether they tend to find factors related to their professional environment (especially the guides to professional conduct of the American Institute of Certified Public Accountants) to be more helpful than factors related to their business environment when faced with ethics problems. Like internal auditors surveyed earlier, the CPAs tend to view a number of factors in their business environment to be even more helpful than factors related to (...) their professional environment in dealing with ethical dilemmas. Implications for CPAs as individuals and for their professional associations are discussed. (shrink)
